Terms of Service

Agreement

These Terms are an agreement between you and Alethex Group Private Ltd (“we”, “us”), the company that operates the AtomicWardrobe app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

Who can use it

You must be at least 13 years old. If you are under 18, you may use the Service only with the consent of a parent or lawful guardian, who accepts these Terms on your behalf and is responsible for your use. You must not use the Service if the law prohibits you from doing so.

Your account

• Give accurate information and keep it up to date.
• Keep your sign-in details secure. You're responsible for activity on your account.
• One person per account. Don't create accounts for others or impersonate anyone.
• Tell us promptly at contact@alethexgroup.com if you think your account has been misused.

Your content

“Your content” means the photos, wardrobe items, outfits, posts, comments, messages and anything else you add. You keep ownership of your content.

So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, adapt and display your content, including processing it with AI to build your avatar, recognise garments, generate try-ons and suggest outfits. For content you post publicly or to followers, the licence also covers showing it to other users. This licence ends when you delete the content or your account, except for content others have already reshared and copies we must keep by law.

You confirm that you have the rights to everything you upload, and that any photo showing another person is shared with their permission.

Community rules

You must not upload, post or send anything that:

• is sexually explicit, contains nudity, or sexualises anyone under 18 in any way;
• harasses, bullies, threatens or shames anyone, including about their body;
• promotes hate or discrimination based on religion, caste, race, gender, sexuality, disability or any other protected characteristic;
• shows another person without their permission, or uses someone else's photos to create an avatar;
• infringes copyright, trademarks or other rights, or is false, misleading or impersonates someone;
• is spam, advertising you haven't been permitted to post, malware, or otherwise unlawful;
• threatens the unity, integrity, security or public order of India, or is prohibited under the Information Technology Act, 2000 and its rules.

You also must not scrape, reverse-engineer, overload or interfere with the Service, or try to access other users' data. We may remove content or restrict accounts that break these rules. You can report content or users in the app or by emailing us.

AI features

Avatars, try-ons, garment recognition and stylist suggestions are generated automatically by AI. They are approximations: fit, colour, drape and proportions may differ from real life, and suggestions may be wrong or unsuitable. They are not professional advice. Use your own judgement before wearing, buying or keeping anything.

Paid features

The Service is currently free. If we introduce paid plans, their price and terms will be shown before you buy. Purchases made through the Apple App Store or Google Play are handled by them and are subject to their terms, including cancellation and refunds. We'll tell existing users before any feature they use becomes paid.

Our rights

The Service, including its software, design, AtomicWardrobe name and logo, and the AI models and outputs we provide (other than your content), belongs to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app for your own non-commercial use, in line with these Terms.

If you send us feedback or ideas, we may use them without obligation to you.

Suspension & deletion

You can stop using the Service at any time and delete your account through our deletion page. We may suspend or close your account, or remove content, if you break these Terms, if the law requires it, or to protect other users or the Service. Where reasonable, we'll tell you why and give you a chance to respond. Sections that by their nature should continue (such as Your content, Disclaimers, Liability and Governing law) survive the end of these Terms.

Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including that the Service will be uninterrupted, error-free, or that AI outputs will be accurate. Nothing in these Terms limits rights you have under consumer protection law that cannot be excluded.

Liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, or for loss of data, profits or goodwill. Our total liability to you for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or ₹1,000. Nothing here limits liability that cannot be limited by law, including for fraud.

Indemnity

If you break these Terms or the law, or your content infringes someone's rights, and this leads to a claim against us, you agree to compensate us for the reasonable losses and costs that result, to the extent the law allows.

Governing law

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka have exclusive jurisdiction, subject to any right you have to bring a claim in the courts where you live. We encourage you to contact us first so we can try to resolve any issue informally.

Changes to these Terms

We may update these Terms. We'll update the date at the top, and for significant changes we'll tell you in the app or by email before they take effect. If you keep using the Service after that, you accept the new Terms.
